Samsung Appealing Apple’s Galaxy Tab ...

Only hours after Judge Lucy Koh granted Apple a preliminary injunction blocking the sale of the Galaxy Tab 10.1 tablet in the United States, Samsung made it clear it plans to appeal the ruling. The electronics maker filed a notice to appeal in the patent infringement case on Wednesday, according to Foss Patents.

Apple and Samsung have been fighting in court over patent infringement claims for over a year and have been seeking injunctions to block each other’s mobile devices from being sold to consumers. Yesterday’s ruling marks the first time Apple has won an injunction in the United States to block the sale of what it sees as an iPad copycat.

In her ruling, Judge Koh stated, “Although Samsung has a right to compete, it does not have a right to compete unfairly, by flooding the market with infringing products.”

Apple still needs to post a US$2.6 million bond before the injunction order goes into effect, and the iPhone and iPad maker hasn’t said when — or if — it plans to do so.

Apple pushed for an injunction that would ban the sale of the Samsung Galaxy Tab 10.1 in the US, but Judge Lucy Koh of the United States District for the Northern District of California denied this motion. according to a report by FOSS Patents, Koh told Apple it had to wait until the United States Court of Appeals for the Federal Circuit (CAFC) issues its mandate on the case. once the CAFC responds, Apple can ask again for an injunction.

This delay will help Samsung, which faces Apple in another court session scheduled for Thursday June 7. Rather than the Galaxy Tab injunction, the session will focus on the injunction Apple filed against the Galaxy Nexus.

Apple wins another one against Motorola in Germany

A German court has ruled that Motorola Mobility violates a patent Apple holds related to the way in which photo galleries are displayed in mobile operating systems.

Another day, another ruling in a German court battle between Apple and Motorola Mobility.

Judge Dr. Peter Guntz of the Munich I Regional Court ruled today that Motorola violates a photo gallery patent Apple holds, according to FOSS Patents’ Florian Mueller, who was in attendance at the proceeding. The ruling gives Apple the opportunity to ban all infringing Motorola products, including two of the company’sAndroid-based smartphones and the Xoom tablet. Mueller didn’t say which two smartphones were included in the suit.

Apple is not compelled to enforce the ban. However, if it does, Mueller says that Motorola would be forced to destroy any infringing products in its possession.

That has become a common theme in recent rulings across Germany. last month, a German court ruled Motorola violated Apple’s slide-to-unlock patent and could have seen its products banned from sale. But Motorola made a quick change to keep its products on store shelves.

“Today’s ruling in the patent litigation brought by Apple in Munich, Germany, concerns a software feature related to phone unlocking in select Motorola devices sold in Germany,” the Motorola spokesperson told CNET at the time. “Motorola has implemented a new design for the feature. Therefore, we expect no impact on current supply or future sales.”

This time around, Motorola says that the ruling came down because of a “zoomed in” function in the photo gallery. that function has been modified to ensure Motorola’s products don’t infringe Apple’s patents.

“Today’s ruling in Munich, Germany on the patent litigation brought by Apple concerns a software feature associated with performing certain functions when viewing photos in a ‘zoomed in’ mode on mobile devices,” a Motorola spokeswoman told CNET in an e-mailed statement. “We note that the Court ruled that performing the functions in a ‘zoomed out’ mode does not infringe on this patent.

“We expect no impact to supply or future sales as we have already implemented a new way to view photos on our products that does not interfere with the user experience,” the spokeswoman continued.

Apple declined to comment on the ruling.

Samsung’s redesigned Galaxy Tab hopes to get ...

Samsung Electronics is relaunching a modified Galaxy Tab 10.1 in Germany it hopes will get around an injunction won by Apple against the original product.

The new product, called Galaxy Tab 10.1n, was first reported on by German news site MobiFlip, and highlighted by Foss Patents. the biggest superficial change is a metal band that extends around the device and bleeds into the front. It’s unclear whether other parts were modified.

Samsung’s change and insistence that it get around the ban marks the latest development in the ongoing legal saga between it and Apple. Apple won an injunction based on the claim that the Galaxy Tab shares too many similarities with its owniPadtablet, part of a legal battle fought in multiple courtrooms around the world.

The ban was instituted in September, when a German court ruled that Samsung violated Apple’s patents. that Samsung is already out with a new version of the Galaxy Tab speaks to its desire to stay in the growing tablet market.

Patent analyst Florian Mueller said in the Foss Patents blog that the redesigned tablet looks like it was a result of cooperation from the product design team and the company’s German lawyers. he added this “ups the ante” on Apple, which could decide to seek another injunction.

Apple has aggressively pursuedAndroid supporters, starting with a lawsuit against HTC, and expanding to others. It’s almost become a mark of success as an Android vendor; show any success and Apple targets you. As a result, Google spent $12.5 billion to acquire Motorola Mobility to get a hold of its patents, and has provided HTC with additional patents for its defense.

Apple’s more litigious activity underscores a broader willingness in the tech industry to lob lawsuits against each other. While not a new practice, the activity has heated up in recent years.

Apple Wins German Injunction Against Samsung ...

Apple has scored a win in their ongoing battle against Samsung. the Galaxy Tab 7.7 manufacturer lost an injunction battle in Germany this week, a decision that has halted the company’s tablet sales in the region.

FOSS Patents has reported that Samsung has pulled the Android Tablet from the IFA show floor in Germany and has also removed the device from the Samsung Germany website in compliance with the Friday decision which was handed down from the same Düsseldorf Regional Court court that also stopped sales of the Galaxy Tab 10.1 in August of this year.

Previously Samsung had placed a sticker on Galaxy Tab 7.7 displays which read “Not for sale in Germany” however by Saturday afternoon all demo models, posters and other promotional displays had been removed completely from the show.

Speaking to Bloomberg Samsung spokesman James Chung said the injunction ”severely limits consumer choice in Germany,” while adding that the Korean manufacturer “respects the court’s decision.”

Samsung officials have promised to continue their fight against Apple, stating that they will defend their own intellectual property rights. in the meantime Apple continues to fight Samsung in courts around the world, claiming that the company has ripped off major aspects of their own Apple iPad and Apple iPad 2 design features and functionality.

We’ve seen how well Microsoft crowding out the market worked in the past, I have a feeling Apple’s relentless attack on other technology firms is going to come back and bite them in the butt in the future.
